I. Purpose
This policy outlines the procedures by which Pick It Up Logistics, Inc. (“Pick It Up Logistics,” “we,” or “our”) enforces its Terms of Service and monitors shipments facilitated through our freight brokerage services. Our goal is to ensure transparency, compliance with applicable laws, and the protection of all parties involved in the supply chain.
II. Enforcement of Terms of Service
A. Contractual Compliance
- All shippers, carriers, and partners must acknowledge and agree to Pick It Up Logistics’ Terms of Service prior to engaging in business.
- Non-compliance with the Terms (e.g., failure to maintain insurance, misrepresentation, or use of fraudulent documents) will result in immediate suspension or termination of access to our services.
B. Monitoring for Violations
- The Compliance Officer and operations team regularly review customer and carrier accounts for discrepancies, such as inconsistent documentation, unusual transaction activity, or violation of prohibited shipment rules.
- Violations may trigger an internal investigation, during which the account may be placed on hold.
C. Corrective and Disciplinary Actions
Depending on the severity of the violation, actions may include:
- Warning notice with a requirement to correct deficiencies.
- Suspension from accessing brokerage services until compliance is restored.
- Termination of the business relationship for repeated or severe breaches.
- Referral to regulatory or law enforcement agencies if the violation involves fraud, illegal products, or sanctioned parties.
III. Shipment Monitoring
A. Prohibited and Restricted Goods
- Pick It Up Logistics maintains a list of prohibited and restricted goods (e.g., hazardous materials without proper permits, contraband, counterfeit goods).
- Shipments are screened at booking and during transit documentation review to ensure compliance.
B. Documentation Review
- All bills of lading, proof of delivery, and related documentation are subject to review for accuracy and completeness.
- Any discrepancies are flagged for further verification with the shipper or carrier.
C. Use of Technology
- Electronic Data Interchange (EDI) and tracking tools provide real-time visibility into shipments.
- Monitoring systems can detect anomalies such as unexpected route changes, delays, or transits through sanctioned regions.
D. Red Flag Indicators
Staff are trained to identify red flags such as:
- Sudden last-minute changes to the destination.
- Mismatched consignee or shipper details.
- Shipments routed through high-risk or sanctioned jurisdictions.
- Incomplete or falsified shipping documents.
IV. Escalation and Reporting
A. Internal Escalation
- Employees must immediately escalate any suspected violations of Terms of Service or shipment irregularities to the Compliance Officer.
- The Compliance Officer will investigate and determine whether corrective action or regulatory reporting is required.
B. External Reporting
- If shipments involve prohibited items, sanctioned parties, or potential fraud, Pick It Up Logistics will notify relevant authorities such as the Office of Foreign Assets Control (OFAC), Department of Transportation (DOT), or law enforcement as appropriate.
V. Training and Awareness
- All employees involved in shipment processing, customer onboarding, and compliance receive mandatory training on:
- Terms of Service enforcement procedures.
- Shipment monitoring protocols.
- Identifying prohibited goods and red flag indicators.
- Training is conducted annually and updated to reflect changes in law, regulation, or company policy.
VI. Record-Keeping
- Records of enforcement actions, investigations, and shipment monitoring activities are retained for at least five (5) years.
- Documentation includes notices of violation, corrective actions, and communications with regulatory bodies.
VII. Non-Compliance Consequences
Failure to comply with this policy or failure to enforce the Terms of Service appropriately may result in disciplinary action against employees, up to and including termination.
